Terms of Service

1. Acceptance of Terms

By accessing or using the Epinote mobile application, website, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service or via email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

  • You must provide accurate, complete, and current information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account at contact@epinote.app.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. The Service

Epinote is an AI-powered fragrance layering application that provides:

  • A searchable catalog of 9,000+ fragrances with detailed note breakdowns, ratings, and metadata.
  • AI-generated layering recommendations and blend analysis.
  • Personalized Scent DNA profiling based on your preferences and collection.
  • Weather-adaptive and context-aware fragrance suggestions.
  • Community features including Scent Circles and shared accords.
  • Affiliate links to purchase fragrances from third-party retailers.

We may modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

5. AI-Generated Content

Epinote uses artificial intelligence to generate fragrance recommendations, layering suggestions, and blend analyses. You acknowledge that:

  • AI recommendations are suggestions based on algorithmic analysis and should not be considered professional advice.
  • AI-generated content may not always be accurate, complete, or suitable for your specific needs.
  • Fragrance preferences are subjective; AI recommendations serve as a starting point for exploration.
  • We continuously improve our AI models but do not guarantee the accuracy of any recommendation.

6. User Content

You retain ownership of content you create or submit through the Service (reviews, ratings, collection data, community posts). By submitting content, you grant Epinote a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with operating and improving the Service.

You agree not to submit content that:

  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
  • Infringes on any intellectual property or proprietary rights of others.
  • Contains malware, spam, or any form of unsolicited commercial content.
  • Impersonates any person or entity, or misrepresents your identity.

We reserve the right to remove any content that violates these Terms without notice.

7. Affiliate Links and Purchases

Epinote participates in the FragranceNet Affiliate Program and may include affiliate links to third-party retailers. You acknowledge that:

  • Epinote may earn a commission when you make a purchase through affiliate links, at no extra cost to you.
  • Purchases made through affiliate links are transactions between you and the third-party retailer.
  • Epinote is not responsible for the products, services, pricing, availability, or policies of third-party retailers.
  • Any issues regarding purchases (returns, refunds, defects) must be resolved directly with the retailer.

8. Intellectual Property

The Service, including its design, features, code, AI models, algorithms, graphics, logos, and content, is the property of Epinote and is protected by intellectual property laws. You may not:

  • Copy, modify, distribute, or create derivative works based on the Service.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use automated systems (bots, scrapers) to access or extract data from the Service.
  • Remove or alter any proprietary notices or labels on the Service.

Fragrance names, brand names, and related trademarks are the property of their respective owners. Epinote's use of these names is for informational and identification purposes only.

9. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of applicable laws.
  • Attempt to gain unauthorized access to the Service, other accounts, or related systems.
  • Interfere with or disrupt the Service or servers connected to it.
  • Upload or transmit viruses, worms, or other malicious code.
  • Harvest or collect information about other users without their consent.
  • Use the Service to promote competing products or services.
  • Circumvent any access controls, rate limits, or security features.

10. Subscription and Premium Features

Epinote may offer premium subscription plans with additional features. If you subscribe:

  • Subscription fees are billed in advance on a recurring basis (monthly or annually) through the App Store or Google Play.
  • You may cancel your subscription at any time through your device's subscription management settings.
  • Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.
  • We reserve the right to modify subscription pricing with 30 days' advance notice.
  • Free trial periods, if offered, convert to paid subscriptions unless cancelled before the trial ends.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure.
  • AI-generated recommendations will be accurate or suitable for your needs.
  • Fragrance data, including note breakdowns and ratings, is complete or error-free.
  • Third-party products purchased through affiliate links will meet your expectations.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EPINOTE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to Epinote in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless Epinote and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination:

  • Your right to use the Service ceases immediately.
  • You may request export of your data within 30 days of termination by contacting us.
  • Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) shall remain in effect.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Epinote regarding the Service and supersede all prior agreements and understandings.
